Investment decisions

The NZTA Board has the responsibility to allocate funds from the National Land Transport Fund. In making its investment decisions, the Board must take account of the Land Transport Management Act 2005 (LTMA) and follow the Act’s requirements for the procurement of activities. Context for decisions

Funding

Under the LTMA, the NZTA is responsible for allocating funds for investment in activities out of the National Land Transport Fund. The NZTA uses an allocation process that has been devised to take into account the IRS and the requirements placed on approved organisations and NZTA's Planning & Investment Knowledge Base.

The NZTA may accept or decline funding for an activity or combination of activities but must consider the matters set out in section 20 of the LTMA. The assessment factors used when considering proposals are the strategic fit, and the effectiveness and economic efficiency of the solution to the issue.

Decisions must be made available on this website in accordance with section 20D(2) of the LTMA.

Procurement

The requirements for procurement procedures are given in section 25 of the LTMA.

The LTMA requires that payments by the NZTA, for state highway activities and nationally managed or delivered activities, must be made in accordance with an approved procurement procedure unless exempt by or under section 26.

If the NZTA grants itself an exemption to an approved procurement procedure on the grounds that the costs of the procurement process would be disproportionate to the value of the proposed activity (or combination of activities), or if the NZTA approves a procurement procedure to meet its own procurement requirements, those decisions must be made available on this website in accordance with section 26A of the LTMA.

Decision making and the scrutiny principle

Legislation requires that for certain land transport planning and funding decisions, the NZTA must give the same level of scrutiny to its own activities as it would give to those of approved organisations. Delegation

Funding and procurement decisions are usually made by the Board of the NZTA, or (prior to 27 March 2009) by the National Land Transport Programme Management Review Group or by the Group Manager, Regional Partnerships and Planning (after 27 March 2009), under delegated authority from the Board in accordance with the Crown Entities Act 2004.

In broad terms, the Board has delegated decision making subject to certain monetary limits for new works cost/scope adjustments, price level decreases, cash flow adjustments, and emergency works.
